3.8 Unless otherwise stated in the Booking Confirmation, all invoicesshall be paid within 14 days of the invoice date. We shall beentitled to cancel a booking in the event that payment is notreceived by us in cleared funds prior to commencement of theAccommodation Period.
4 CHARGES
4.1 The Price includes the following (the “Included Costs”):
(a) heating, electricity, gas and water used at the Apartmentduring the Accommodation Period;
(b) any rent or service charges payable in respect of theApartment;
(c) any council tax, television licence and telephone line rentalcharges;
(d) a weekly maid service;
(e) bed linen and towels (changed weekly);
(f) weekend telephone calls to UK landlines (excludingpremium rate numbers);
(g) unlimited internet usage;
(h) a welcome pack;
(i) personal “check-in” (Monday to Friday 9am – 5pm (“officehours”)); and(j) toiletries provided at the start of the Accommodation Period.
4.2 You shall be liable for all additional costs (“Additional Costs”)incurred by the Occupier including without limitation:
(a) the cost of replacing or repairing any breakages or damageto the Apartment or any of its contents which shall becharged at the cost of replacement or repair plus an admin.fee of 20% of such cost;
(b) the cost of specialist cleaning when more than routinecleaning is required;
(c) the cost of any additional housekeeping services beyondthose covered by the Included Costs (details available onrequest);
(d) personal "check-out", where requested, and/or personal“check-in” outside office hours or on national holidays at £95per "check-in" or "check-out";
(e) "check-in" or "check-out" inventories, where requested, at£65 (1 bed) and £85 (2 bed) per "check-in" or "check-out";
(f) the cost of replacing lost keys, fobs/swipes or car parkpasses at £45 each;
(g) call out charge to gain entry at £50 during office hours and£95 at all other times and on national holidays. Anyspecialist charges (such as those of a locksmith) will beadditional and charged at cost plus an admin. fee of 20% ofsuch cost;
(h) provision of any other services which are not covered by theIncluded Costs; and
(i) any other financial costs or losses suffered by us (togetherwith our admin. costs) where the Apartment cannot beimmediately reoccupied due to the acts or omissions of theOccupier including due to any damage caused by theOccupier or the requirement for specialist cleaning orrepairs.
4.3 We may require a credit card deposit from you or the Occupier tocover any Additional Costs prior to the commencement of theAccommodation Period (the “Deposit”).
4.4 In the event that the Deposit is insufficient to cover anyAdditional Costs incurred, or where no Deposit is held, we willinvoice you for any Additional Costs (or the balance of the same,as applicable) for payment by you within 14 days of the invoicedate.
4.5 In the event that no Additional Costs are incurred, or the total ofthe Additional Costs does not exceed the Deposit, we will refundthe Deposit (or the balance of the same, as applicable) to you orthe Occupier (as applicable) within 14 days of the end of theAccommodation Period.
5 IF YOU CANCEL A BOOKING
5.1 In the event that you wish to cancel a booking after the date onwhich we issue the Booking Confirmation but prior to thecommencement of the Accommodation Period the followingwritten notice must be given by you:
(a) if the Accommodation Period is for 31 days or less, at least20 days written notice prior to the commencement of theAccommodation Period;
(b) if the Accommodation Period is for 32-90 days inclusive, atleast 25 days written notice prior to the commencement ofthe Accommodation Period; and
(c) if the Accommodation Period is for more than 90 days, atleast 30 days written notice prior to the commencement ofthe Accommodation Period.
5.2 The notice periods referred to in Condition 5.1 shall be deemed to run from the date on which we receive your written notice. We shall be entitled to treat your booking as cancelled from such date and shall have no further liability to you.
5.3 Where sufficient notice is provided, any sum that you have paidin respect of the Price shall be refunded and any Deposit paidshall be refunded to you or the Occupier (as applicable).
5.4 Where insufficient notice is provided, any sum that you have paidin respect of the Price shall be refunded less a cancellationcharge. This charge shall be the nightly cost of the Apartmentmultiplied by the number of day's notice that you were requiredto give pursuant to Condition 5.1 less the actual notice given (ifany) (the "Cancellation Charge"). For example, if 20 days'written notice is required under Condition 5.1(a) and only 14days' notice is given you shall be liable for the nightly cost of theApartment multiplied by 6.
5.5 Should an Occupier fail to arrive at the Apartment by 11am onthe day after the commencement of the Accommodation Periodand we have not been advised of a late arrival, we shall beentitled to treat your booking as cancelled and subject to theCancellation Charge.
5.6 Any Cancellation Charge shall be payable within 14 days of theinvoice date.
6 BOOKING EXTENSIONS
6.1 In the event that you wish to extend the Accommodation Period,you should contact us as soon as possible.
6.2 Extensions are subject to the availability of the Apartment andshall be at our sole discretion. An alternative apartment may beoffered if the Apartment has been booked for all or part of therequired extension period.
6.3 We may increase the Price of the Apartment for any period ofextension.
6.4 Any extension period will be treated as a new booking and willbe invoiced accordingly.
7 FORCE MAJEURE
7.1 We reserve the right to defer the start of the Accommodation Period, cancel the booking or make a material change to thebooking if we are prevented from, or delayed in, the carrying onof our business due to circumstances beyond our reasonablecontrol including, but not limited to: acts of God, governmentalactions, war or national emergency, acts or threats of terrorism,protests, riot, civil commotion, telecommunications, internet orsatellite failure, fire, explosion, flood, epidemic, lock-outs or otherlabour disputes, destruction or damage of the Apartment or anycommon parts by any cause, determination of any superior leaseor to ensure compliance with any permissions, licence or statuteor revocation or amendments thereof (a “Force MajeureEvent”).
7.2 We will contact you as soon as reasonably practicable in theevent of us having to cancel or materially change a booking dueto a Force Majeure Event.
7.3 We will not be liable for any loss or damage suffered by you orthe Occupier due to any cancellation or change by us of yourbooking or due to any failure by us to perform our obligations orany loss of services (including, without limitation, the provision ofgas, electricity, water, internet or any telecommunications) at theApartment which is due to a Force Majeure Event.
7.4 If we have to cancel your booking or make a significant changeto it due to a Force Majeure Event we will attempt to provide youwith an alternative comparable apartment for the same period asthe Accommodation Period. You shall advise us as soon aspracticable whether you wish to accept any alternative apartmentoffered to you.
7.5 If the Force Majeure Event arises prior to the commencement ofyour Accommodation Period, and you do not wish to accept asignificant change or an alternative apartment or we cannot offeryou a suitable alternative apartment, you will receive a refund ofall sums paid to us in advance in respect of the Price and theDeposit (if applicable) but we will not be liable for any costs orcharges you incur, including in connection with the arrangementof alternative accommodation.
7.6 If the Force Majeure Event arises during your AccommodationPeriod, and you do not wish to accept a significant change or analternative apartment or we cannot offer you a suitablealternative apartment, you will receive a refund of all sums paidto us in advance in respect of the unexpired part of theAccommodation Period, but we will not be liable for any costs orcharges you incur, including in connection with the arrangementof alternative accommodation.
7.7 Without prejudice to our rights and remedies, if, at any timeduring the Accommodation Period, we become aware of:(a) anti-social behaviour or damage on the part of the Occupierat the Apartment; or
(b) any breach of the Conditions or Booking Confirmationwe may cancel the booking immediately and ask theOccupier to leave the Apartment. This will be deemed acancellation by you and you shall be liable for the Price infull plus any Additional Costs incurred. No refund of anymonies you have paid in respect of the Price will be madeand we shall have no further liability to you.
